Online poker in the Netherlands in 2024: legal background
Although the Netherlands can be considered as a very liberal country in several aspects, when it comes to online gambling, the situation is highly different, at least on paper. In theory, Dutch players can only join licensed poker rooms, and it's illegal to join offshore sites. A project to regulate Netherlands online poker sites was introduced in 2016.
In 2021 the Kansspelautoriteit (KSA) made good on that threat, and since October 1, 2021, major operators pulled out of the Netherlands waiting for approval to return (and pay over 30% in taxes). The Dutch poker market is so profitable that most likely, all sites will return in the mid-term. Online gambling sites like partypoker, Unibet pulled out of the country due to the new regulation.
Big changes were implemented in October 1, 202:
- Deposit limits: Players will be able to deposit up to €700 per month (€300 for players aged 18-24). The only way to increate this limit is to send a proof of income to the poker operator; however, only up to 30% of the income can be deposit. New players will be required to set a limit when creating the gaming account
- Responsible gambling: Pop-up messages will be shown every 30 minutes. All new players setting a deposit limit higher than €300 must be contacted by email or chat to confirm they are aware of the risks
- Currency: The balances in the cashier must be displayed in EUR.
- Time limits: Players are required to set a gambling time limit (per day, week, month). Once such limit is reached the player will be logged out of the platform and a 30-day bonus block will be applied.

Poker taxes in the Netherlands
In 2018 a curious precedent was set in the online poker industry. The Dutch tax office (Belastingdienst) was forced to return millions of euros in taxed charged to PokerStars.EU players.
